Material Management & Accounting Systems (MMAS) Expert Testimony
Engaged by the US Attorney Illinois Southern District to prepared an expert report and expert witness testimony involving a Qui Tam action against a major defense contractor and allegations that its MMAS led to overstated payment requests and false claims to the government. Following experts’ depositions a settlement was reached awarding the government and the plaintiffs $62M.
Direct Commercial Contracts (DCC) with Foreign Governments Govern by the Foreign Military Financing (FMF) Guidelines as Prescribed by the US Defense Security Cooperation Agency
Engaged by plaintiff’s attorneys to prepare an expert report and expert witness testimony involving a Qui Tam action against a major defense contractor and allegations that its DCC contract led to overstated payment requests and false claims to the government.
Aerospace Manufacturer Qui Tam Matter
Prepared an analysis in defense of a prime contractor regarding a plaintiff’s allegations of accounting non-compliance in a qui tam action.
International Aerospace and Defense Contractor Government Investigation
Engaged by outside Counsel and the General Counsel of an Aerospace & Defense client to perform a forensic investigation of travel-related transactions to determine the extent of potential government over-billing. The forensic investigation was in response to an inquiry and possible investigation conducted by the US Attorney District of Columbia. The investigation determined that the contractor had complied with government cost compliance regulations. Following a presentation of such findings to the US Attorney, this matter was closed with no liabilities assessed upon the client.
Not-for-Profit Organization Accused of False Claims by USDOJ
Engaged by outside Counsel and the General Counsel of a Not-for-Profit client to assist in defense of False Claims brought forward by USDOJ related to lease payments and lease arrangements with a related party. Following a presentation of defense arguments to the USDOJ, this matter was settled administratively with all false claims matters dismissed.
Dept. of Veterans Affairs (VA) Investigation
Developed a potential damages assessment for a major drug manufacturer under investigation by the VA Inspector General regarding potential overpricing and fraud allegations of VA schedule contract drug benefits leading to a voluntary disclosure assessment of over $100M.
Electronic Warfare Training Systems
Developed a supportable basis for demonstrating linkage between the various entitlements and causation events, and the quantum impacts in an appeal of a $32M certified claim against the Department of the Air Force.
Military Tactical Vehicles
Developed a supportable basis for demonstrating linkage between entitlement and quantum in a $13M Request for Equitable Adjustment claim for interference, disruption and delay brought by a prime contractor before the Department of the Army.
Infrared Radar Systems
Conducted a detailed review of a prime contractor’s $80M certified claim for disruption, delay and uncompensated changes against the Department of the Air Force for purposes of recommending changes and improvements to the quantum package prior to trial.
Helicopter Manufacturing Convenience Termination
Developed a settlement proposal and related claims for uncompensated changes on behalf of a major subcontractor for their contract which was terminated for convenience by the prime.
Shipboard Anti-Missile Systems
Prepared the quantum package and provided extensive support in developing the entitlement elements for a $28M certified claim for delay and disruption by the Department of the Navy on behalf of a prime contractor.
Leader-Follower Programs
Prepared a $39M damages package for a prime contractor relating to damages inflicted upon it by another prime contractor in a government leader-follower program for development of a second source in a major missile program.
Aircraft Modification Centers
Developed the entitlement and quantum elements for a $25M subcontractor claim against the prime contractor for damages resulting from interference by the prime in the subcontractor’s performance of their contract.
